Lukardi S.A. is responsible for the use of personal data in a secure manner and in accordance with applicable laws, in particular the provisions of the RODO.
We take special care to ensure that your personal information is:
- processed lawfully, fairly and transparently;
- collected for specific, explicit and legitimate purposes and not subjected to further processing incompatible with those purposes;
- correct, updated as necessary and relevant to the purposes for which they are processed;
- stored in a form that allows identification of the persons to whom they relate, for no longer than necessary to achieve the purpose of processing.
3 Purposes and legal basis for data processing
We may process your personal data to:
- to provide you with information, including commercial information, about the services we provide, including those provided electronically, and to allow you to ask and answer questions about our offerings;
- Present you with information related to the bidding process;
- enable you to take part in recruitment processes if you are interested in working with us;
- enable you to subscribe to a newsletter or other channels of information about Lukardi S.A. products and services;
- enable you to participate in webinars and other similar events organized by Lukardi.SA.
We would like to inform you that providing personal data is voluntary, but necessary in order for us to fulfill the above purposes. By participating in the recruitment process, you voluntarily provide us with your personal data. However, if you are applying for employment on the basis of an employment contract, failure to provide personal data to the extent listed in Article 22(1) §1 of the Labor Code will prevent us from considering your application. Provision of personal data other than those listed therein is done solely on your initiative and with your consent, and failure to provide such data will not have negative consequences for you.
If you apply for employment under a civil law contract - you shape the catalog of personal data provided to us on your own, based on your consent.
The legal bases for processing personal data for the above purposes are as follows:
- Article 6(1)(a) of the RODO - when you have given your consent (e.g., to receive an answer to a question asked via a contact form; to participate in a recruitment process);
- Article 6(1)(b) of the RODO - for the purpose of entering into a contract or performing a contract between us;
- Article 6(1)(c) of the RODO - in order to fulfill our legal obligations (e.g., processing complaints);
- Article 6(1)(f) of the RODO - for purposes arising from our legitimate interests (keeping statistics, analyzing data in order to improve the services provided, direct marketing of our own products or services, assertion of business claims, intra-group administrative purposes).
4 Scope and processing of personal data
General information
We ensure that each person using the services of Lukardi S.A. has control over his/her personal data, which he/she provides to us. The data obtained, in this way, about the user is used only for the purposes necessary for the services we provide.
On the website www.lukardi.com, there may be links that will redirect the user to other websites (e.g., websites of Partners cooperating with Lukardi S.A.). A different privacy policy may apply to external websites that we do not control. Before providing personal information on these sites and for the administrators of these sites, we recommend that you read the privacy policy in effect on these sites.
In order to provide services electronically, Lukardi S.A. may also use external websites, such as the websites of its Partners. An example would be our job application forms, which are posted on our Partners' websites. We assure you that all entities with which we cooperate for the purpose of providing our services provide guarantees of due data protection, about which more information can be found in § 6 of this Privacy Policy.

Through www.lukardi.com, you can use the contact forms to send an inquiry or participate in the recruitment process. Personal data obtained in this way will be used for the above purposes and only with the consent of the contacting person.

Personal data will not be subject to automated decision-making (including in the form of profiling).
6. information about entities with whom we may share personal data
Lukardi S.A. may entrust personal data to third parties, including its associates and Lukardi Group companies only within the limits of applicable law. We share your personal data only when it is necessary for the purpose for which the data was collected and to entities that guarantee the security of personal data processing. Lukardi S.A. ensures that the transfer of personal data to other entities does not affect the security of such data. Therefore, each time we oblige the entities with which we cooperate to apply no less stringent rules for the processing of personal data than we apply ourselves, in accordance with the law.
For example, we may share your data with entities that provide legal, courier, IT, statistical, accounting, and recruitment services to us. If we are required to do so by law, your data may be disclosed to such entities as courts or law enforcement agencies.
7. information about the possibility of transferring data to a country outside the European Economic Area or an international organization
Given the above-described cooperation with the providers of social networking tools and services Google and Facebook, your data may be processed by these entities outside the European Economic Area - due to the fact that the headquarters of these entities are located in the USA. At the same time, we would like to inform you that these entities have undertaken to comply with the principles of due data protection by applying the standard contractual clauses adopted by the European Commission.
8 Period of storage of personal data and criteria for determining this period
The storage period of personal data depends on the purpose and legal basis of processing. If Lukardi S.A. processes personal data on the basis of:
- given consent - the period of processing of personal data lasts until such consent is withdrawn by the data subject or the purpose of the processing ends; for example, if you have consented to the processing of personal data for recruitment purposes, the data will be processed until the consent is withdrawn or for 12 months from the end of the recruitment process in question, for the purpose of defense against claims (unless you have consented to participate in future recruitment processes - in which case the data may be used by us in future recruitment processes until the consent is withdrawn);
- legitimate interest of Lukardi S.A. such as permitted marketing activities, debt collection, conducting legal proceedings archiving of documents - the period of processing lasts until the aforementioned interest ceases to exist (e.g. the statute of limitations for civil law claims) or until the data subject objects to further such processing - in situations where such objection is due under the law;
- a contract to which the data subject is a party, or in connection with the need to take steps prior to the conclusion of such a contract, at the request of the data subject - the period of data processing lasts for the duration of the contract, until the statute of limitations for claims related to it;
- applicable laws, e.g., in connection with the storage of accounting documents - the data processing periods for this purpose are determined by these laws.
Lukardi S.A. retains personal data only for such period of time as is justified by the purpose for which the data were collected and as permitted by law.
9. rights of data subjects
Each user has the following rights:
- The right to receive information about what personal data we process, from when, from what source we received the data, for what purpose, to what extent and in what way it is processed, and to what entities it is shared;
- The right of access to personal data;
- The right to data portability;
- The right to request that personal data be supplemented, updated, rectified, temporarily or permanently suspended or erased if it is incomplete, outdated, untrue or was collected in violation of the law or is no longer necessary for the purpose for which it was collected;
- if the data are processed for purposes arising from legitimate interests pursued by Lukardi S.A. or by a third party (e.g. for direct marketing of our products or services) - the right to object to such processing on grounds relating to the specific situation of the data subject. Once an objection has been lodged, we will no longer process the personal data unless there are compelling legitimate grounds for the processing that override the interests, rights and freedoms of the objector, or if there are grounds to establish, assert or defend claims;
- The right to restrict the processing of personal data;
- The right to withdraw consent if the processing is based on that consent. The withdrawal of consent does not make the processing that took place before the withdrawal of consent illegal. Likewise, the processing of personal data of a person who has withdrawn consent will be legal if, despite the withdrawal of consent, we can process personal data on a basis other than consent, or if we are required by law to continue processing the data.

We will respond to each request related to the realization of the above-mentioned rights immediately, but no later than within 1 month, even if it is not possible to fulfill the request of the request within such time. In this case, we will inform you of the action taken.
10. right to lodge a complaint with the supervisory authority
Any data subject has the right to lodge a complaint with the President of the Office for Personal Data Protection in the event of a violation of data protection laws.

Lukardi S.A. reserves the right to modify the privacy policy in order to adapt it to current legal requirements. The current version of the privacy policy is always available on our website.
